Do you have legal expenses insurance? Then you have the right to choose your own lawyer to handle your case. This is stated in the law. The policy conditions of your insurance often state that you will receive legal aid from an independent organisation. This does not mean that you are obliged to accept that in-kind legal aid. You may choose a lawyer yourself.
Many insurers are trying to block this
Many insurers try to discourage you from choosing your own lawyer. For example, they say it is too expensive or that it is not possible. Do not be put off by this. There are court rulings that say you have the right to choose your own lawyer.
Your insurer must reimburse your lawyer’s costs
If you choose your own lawyer, your insurer must reimburse reasonable and necessary costs. This does not mean that you can always claim the costs. Insurers are allowed to limit reimbursement for external legal assistance. However, this should not go so far that you cannot in practice choose a lawyer that suits you.
You are entitled to compensation for external costs in the event of dismissal
If you have been dismissed or are dismissed, you are in principle entitled to reimbursement of external legal aid costs by the insurer.
